The general use of our website www.godiamaltajoyeria.com or placing an order through it implies the full and total acceptance by the User or Client of the General Purchase Conditions and Privacy and Data Protection Policies detailed herein, which GODIAM reserves the full right to modify, with the applicable conditions being those in force at any given time.

GENERAL INFORMATION and OBJECT:

In compliance with Article 10 of Law 34/2002 of July 11, on Information Society Services and Electronic Commerce (LSSICE), the identifying data of the Company are set out below:

The website www.godiamaltajoyeria.com, hereinafter the WEB BOUTIQUE, operates under the trade name GODIAM JEWELS, hereinafter GODIAM, which is owned by GODIAM, S.L., a Spanish company with C.I.F. B15905284 and registered office at C/Merced, 75B 4D in the city of La Coruña-Spain.

These General Online Purchase Conditions aim to regulate the offer and distance selling of any product present in the WEB BOUTIQUE by the User or Client.

Therefore, the contractual relationship established at a distance between GODIAM and the Clients is governed by these General Purchase Conditions, as well as by Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws; by Law 34/2002, of July 11, LSSICE, as well as by any provision contained in the regulations that are mandatory for businesses in their relations with consumers.

Therefore, our company commits to having all Jewels displayed in our WEB BOUTIQUE available at the current time the Client places the order. The items are explicitly shown in each of the enabled sections in the WEB BOUTIQUE. In the Purchase Sheet of each product, you can see in detail the specific characteristics of each of our Jewels.

Whenever deemed appropriate, GODIAM will update and/or modify prices and items according to strictly commercial criteria of the Company.

The products will conform to the Contract provided they match the description made by us and possess the qualities we have presented in our WEB BOUTIQUE, are suitable for the uses ordinarily intended for these items, and present the quality and performance expected of a product of this nature.

Given the specific and special characteristics of the jewelry produced by GODIAM and marketed on our website, and fundamentally due to the particularities of the highest quality natural materials and gems we select and use in their artisanal manufacturing process, slight differences may occasionally exist between each purchased product, such as slight variations in the shape of the piece, in weight, as well as small variations in the tone of the metal and the color of the natural stones used. Therefore, even with the same model, no two GODIAM jewels are exactly alike, which is why these absolutely natural characteristics should not be considered defects or flaws, but quite the contrary; we must appreciate them as they form part of the natural and unique essence of the Jewel.

Likewise, the Client is informed, accepts, and is aware that sometimes the size of the photographs contained and displayed on our website does not correspond to the actual size of the GODIAM products offered.

For all these reasons, the Client is duly informed and expressly understands and accepts these circumstances and natural differences or variations, without them being able in any case to constitute grounds for withdrawal or cause for termination of the Contract.

PRICE:

The prices of the products presented in the WEB BOUTIQUE include all applicable taxes (VAT and other legally established indirect taxes, depending on the corresponding area).

Prices are expressed in euros and do not include shipping costs unless otherwise indicated.

We work with noble raw materials, primarily gold and diamonds, which fluctuate constantly, so prices may change at any time. However, these possible variations will in no case affect orders for which we have already sent a Purchase Confirmation prior to that possible price modification.

Customs declaration and international taxes and fees:

All international shipments, as well as shipments to the Canary Islands, Ceuta, and Melilla, will be accompanied by an export/import declaration to the customs authorities. This document reflects the total amount of the order. For the Canary Islands, the legally established indirect tax (IGIC) will apply, which will be detailed beforehand in the shipment.

For shipments outside the EU, the Client must pay at the time of delivery the amount corresponding to import and export duties or other national taxes levied on the product in the collection territory.

PAYMENT METHODS:

The Client may choose the payment method once the purchase process is completed from the following available options:

  • Card payment: GODIAM provides its Clients with a secure electronic payment gateway for credit and debit cards (Visa, Mastercard, and American Express).
  • Payment by Paypal.
  • Payment by bank transfer or deposit: This will be done by making the transfer from the Client's bank to the GODIAM account indicated in the checkout section, then sending the proof to info@godiamaltajoyeria.com. Once payment is confirmed by our administration department, the product will be shipped.
  • Installment payment with the financing company Plazox.
  • Express Payment through Shop Pay, Apple Pay, and Google Pay.

GODIAM uses third-party services for the electronic payment process, particularly those of the BANCO BBVA financial entity's payment gateway (online payment gateway, which functions as a virtual point-of-sale terminal). Service providers will request certain data from the Client to make the payment, according to the payment methods they offer. Once the payment process is successfully completed, the contract will be considered concluded, and GODIAM will confirm said contract to the Client via email within a period not exceeding 24 hours.

By authorizing the payment, the Client confirms that the credit or debit card belongs to them. Credit or debit cards are subject to checks and authorizations by their issuing entity, so if said entity does not authorize the payment, GODIAM will not be responsible in this case for the non-delivery or delayed delivery of the order, thus the purchase is not finalized.

We commit not to store, under any circumstances, sensitive information such as card numbers or authentication codes.

CONTRACTING PROCEDURE:

Before contracting, the Client will have at their disposal all the information related to all the steps that must be followed for the conclusion of the electronic distance purchase contract for products and services available in the WEB BOUTIQUE.

The online purchase process in our WEB BOUTIQUE consists of the following phases:

I. Purchase, II. Data Form, III. Payment, IV. Order Confirmation, and V. Shipping

The Client must follow these steps of the purchase process, filling in or checking all the information requested in each of them.

Finally, during the purchase process, the Client will be required to provide the necessary data for the correct control and execution of their order. The billing data will be those listed in the user's registration.

GODIAM is not responsible for errors made by the Client in the data provided to us for the purchase, which, as previously developed in section 2, must be accurate and truthful. This is why the Client must pay special attention when completing the Data Form (step II of the online purchase process), without prejudice to the possibility of correcting said data after the purchase has been made, whenever possible.

SHIPPING AND DELIVERY:

Unless expressly stated otherwise during the online purchase process, the procedure for delivering the GODIAM product or service acquired through the Service to the Client will be carried out according to the following steps:

  • The shipment will be made to the address expressly indicated by the Client during the purchase process, as filled in the Data Form (step II).
  • The shipment will be carried out by means of a courier service provided by a third party external to GODIAM.
  • The product paid for by the Client will be sent within a maximum period of 25 days from the date of the Order Confirmation. If there is any problem in processing your order or shipment, GODIAM will contact the Client immediately to inform them of the incident; in this case, we will give you the option to proceed with the purchase by establishing a new delivery date or to cancel the order placed, refunding the total amount paid. Delivery will be considered to have occurred, or the order to have been delivered, at the moment the Client (or a third party designated on their behalf) acquires material possession of the product or products, which will be accredited by signing the receipt of the order at the delivery address previously indicated in the purchase process.

Unless expressly established otherwise in the online purchase process, the shipping costs of the products displayed in our WEB BOUTIQUE acquired by the Client through the Service will be fully borne by GODIAM.

Impossibility of delivery:

In the event that it is impossible for us to deliver your order to the address expressly indicated by you, we will look for a safe place to leave it. Due to the nature of our shipments, we will never leave them in a mailbox.

We will contact you immediately to inform you where your order is and how to collect it.

If, on the contrary, we cannot find a completely safe place, the Client must set a new delivery date for their order with the transport company. If not, you must contact GODIAM to notify us of the incident. If ultimately the Client does not contact us, their order will be returned to our Company, indicating how to have it sent again, with the Client bearing the costs of return and new shipment in this case.

RETURNS POLICY:

Right of withdrawal:

In case of not being satisfied with a purchase, the Client acting as a consumer and user has the right to withdraw from the Contract within 14 calendar days following receipt of the order. Consequently, the withdrawal period will expire 14 calendar days from the day the Client or a third party designated by them, other than the carrier, acquired material possession of the product or products comprising their order.

To exercise this right, the Client must write us an email before the indicated deadline expires to devoluciones@godiamaltajoyeria.com, notifying us of their decision to withdraw from the Contract through an unequivocal statement, filling out the following form. Under no circumstances will returns that do not comply with the procedure and channels established by the Company be accepted.

The Client will not have the right to withdraw, in any case, from personalized or special orders, size adjustments different from the standard previously modified, and engraving of the jewel.

Returns of products that have been tampered with, show signs of use, have suffered any damage, or from which the security seals have been removed will not be accepted. Therefore, we ask you to be careful with the product(s) while they are in your possession.

The return will be made to the same address from which we sent it. Shipping costs will always be borne by the Client. Returns of items sent postage due will not be accepted. Due to the type of product and looking out for your safety, we recommend sending the return of the order via a courier company. In this case, GODIAM is not responsible for nor does it guarantee the shipping method ultimately used by the Client for the return of the order.

All our jewels incorporate a security tag that allows the piece to be tried on, but not used and subsequently returned. Once the security tag or seal is cut or tampered with, the jewel cannot be returned.

Important: Products purchased during GODIAM SPARKLING DAYS, GODIAM ANNIVERSARY, and GODIAM BLACK WEEK promotions can only be exchanged for another product of equal or greater value, or for a credit for its value redeemable at www.godiamaltajoyeria.com with no expiration date. Under no circumstances will a refund of the purchase amount be made for these promotional events.

Effects of withdrawal:

It is essential to return the item including its original packaging, Certificate of Quality and Authenticity, and other documents or gift items that may accompany it.

As proof of your return, we recommend that you always keep the courier's ticket or receipt, thus confirming the fact that you have delivered and sent the package.

Once we receive the return shipment, our team will check and examine that the received product is in the same condition in which it was sent, and in that case, the refund of the amount paid by the Client will proceed as soon as possible (within a period of less than 15 business days).

All payments received from the Client will be refunded, including purchase costs if any (with the sole exception of additional costs resulting from the Client's choice of a return method different from the least expensive delivery method we offer). The means used for the refund will be the same payment method used for the purchase.

Returns of defective or incorrect products:

At GODIAM, all our items go through strict quality controls in the different production phases. In addition, we carefully review the products before sending each order to the Client.

However, in cases where you consider that at the time of delivery and receipt of your order the product does not conform to what is stipulated in the Contract, you have received another product by mistake, or it suffers any damage or defect, you must contact us immediately by sending an email to mipedido@godiamaltajoyeria.com, indicating the type of incident. Our staff will proceed to carefully examine the defective or incorrect product, and we will communicate to you by email within 14 days following the date of receipt of the return the confirmation of whether a refund is applicable, in case of withdrawal on your part, or the replacement of the item in case it presents any defect or flaw.

The amounts paid for those products that are returned due to a defect or flaw, provided that it is verified that these actually exist and are inherent to their production, will be fully refunded, including the delivery costs of your order, if any, as well as the costs you incurred to return the product to us. In any case, the rights recognized by current legislation are preserved.

GUARANTEE:

GODIAM designs and produces all its jewelry in La Coruña (Spain), thus guaranteeing its Clients products and services of the highest quality.

All our pieces are made with first-law gold of 750 thousandths (18 carats).

In its capacity as manufacturer or producing company, GODIAM directly acquires the diamonds it uses for the production of its jewelry directly from the place of origin, acting in compliance with the conditions of the Kimberley Process, an international system that regulates the diamond market to ensure they come from conflict-free zones.

In accordance with the provisions of Law 23/2003 of July 10 on Guarantees in the Sale of Consumer Goods, GODIAM, as the manufacturer of the products displayed in our WEB BOUTIQUE, will be liable to the Client for any lack of conformity due solely to manufacturing defects existing at the time of delivery and manifesting within the following 2 years.

The period available to the Client to notify any incident caused by manufacturing defects is 2 months from the receipt of the item.

If we check and corroborate the existence of a defect inherent to the manufacturing of a product, always at the Client's choice and when formally notified within the established deadlines, we will immediately proceed to repair the defect or replace the item.

The following will not be understood or accepted as manufacturing defects:

  • Impacts and scratches caused by the normal use of the item.
  • Stains or changes in the brightness of the gold, diamonds, other gems, and materials composing the jewel caused by external chemical agents.
  • Detachment or breakage of gems or other applied elements due to falls or sharp blows.
  • General damage caused by improper or abnormal use of the jewel.

Any guarantee will be voided if the product is tampered with by third parties or by personnel not authorized for this purpose by GODIAM.

In any case, and without prejudice to what is established at the beginning of the section, all products acquired by the Client through the purchase process established in our WEB BOUTIQUE have the legal guarantee inherent to consumer goods, that is, their conformity with their description therein and with these General Conditions.

CERTIFICATE OF QUALITY AND AUTHENTICITY:

Each of our jewels is unique, which is why they are accompanied by their Certificate of Quality and Authenticity. It is the ID of the piece.

For diamonds of 0.30 carats and above, we can issue an international GIA (Gemological Institute of America), HRD (Hoge Raad voor Diamant, granted by the Diamond High Council of Antwerp), or IGI (International Gemological Institute) certificate, the most prestigious laboratories worldwide that record the fundamental data of the diamond and describe in detail all the properties and characteristics that determine its value.

For diamonds smaller than 0.30 carats, GODIAM issues its own Certificate.

The Client explicitly accepts the description and detail of the characteristics of the diamonds reflected in the delivered certificates. Consequently, GODIAM will not respond to any subsequent dispute that may arise in this matter.

LIABILITY:

GODIAM cannot be held responsible for damages caused to the Client or third parties attributable to:

  • The delay in execution or non-execution of the Service due to third parties, such as the delay or non-transmission of communications by telecommunications intermediaries contracted by the Client.
  • The delay in execution or non-execution of deliveries due to third parties contracted by GODIAM in compliance with the contract. Just as in the design and execution of all our jewels, we strive for excellence in delivery times to guarantee total Client satisfaction. Therefore, although GODIAM only works with prestigious transport companies (Nacex, FedEx, UPS, ...), it can only control the timely departure of each shipment. Although not usual, delivery delays may occur that are beyond our control. In this case, a delivery with a reasonable delay will not grant the Client any right to financial compensation or cancellation of the order.
  • The impossibility of creating the necessary connection for the provision of the Service, the interruption of said connection, whatever the type, or problems in the shipment provided these are caused by third parties external to our Company.
  • Errors in the data provided to GODIAM by trustworthy third parties.
  • Errors or defects of a technical nature, whatever the type, in the event that the regularity of our WEB BOUTIQUE is affected as a consequence of interventions whose origin or cause GODIAM has no direct control over.

We will likewise not be responsible for any breach or delay in the fulfillment of any of the assumed obligations, when it is due to events beyond our control or competence. These events, or force majeure causes, will include any act, atmospheric phenomenon, accident, omission, or lack of exercise that is clearly beyond our control, such as strikes, lockouts, invasion, riot, threat, terrorist attack, war (declared or not), earthquake, tidal wave, storm, flood, fire, explosion, other natural disasters, epidemic, impossibility of using any means of transport (public or private), decrees, regulations, legislation, or restrictions of any government or public authority.

INTELLECTUAL AND INDUSTRIAL PROPERTY:

All content displayed on our website (including graphic design, source code, texts, graphics, illustrations, logos, photographs, trade names, trademarks or distinctive signs, and other elements appearing on the Portal), unless expressly indicated otherwise, are the exclusive property of GODIAM or third parties.

The Client may use said material only in the manner expressly authorized by us, which will not prevent them from using our WEB BOUTIQUE to the extent necessary to copy information about their order or contact details; they may view and obtain a temporary private copy of the contents for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided it is not for the purpose of developing collective or commercial or professional activities.

COMMUNICATIONS AND NOTIFICATIONS:

Applicable regulations require that part of the information or communications we send to the Client be in writing. For contractual purposes, the Client consents to use this electronic means of communication and acknowledges that all contracts, information, notifications, and other communications that we send electronically comply with the legal requirements of being in writing. This condition will not affect your rights recognized by law.

In accordance with what is expressed in the previous paragraph, and unless stated otherwise, we may send communications to the Client either to the email or postal address previously provided during the purchase process when placing an order.

JURISDICTION AND APPLICABLE LAW:

Our primary goal is the satisfaction of our Clients.

However, in the undesired event that discrepancies or differences arise as a consequence of the performance, execution, and/or interpretation of the General Conditions and/or the Contracts concluded between the Client and GODIAM, the Client will be urged to contact us without delay.

GODIAM will try as far as possible and reasonable for the problems, observations, and/or claims submitted by the Client to reach a successful conclusion through constructive dialogue, but always appealing and referring to the Terms of Use clearly exposed and detailed in our WEB BOUTIQUE.

The use and purchase contracts for the products displayed through the WEB BOUTIQUE are governed by Spanish legislation. In the event that the parties ultimately fail to reach an amicable agreement leading to a suitable solution, they will waive their jurisdictions, and the dispute arising from these purchase conditions will be submitted to the jurisdiction and rulings of the courts and tribunals of the city of La Coruña.

DATA PRIVACY POLICY:
